Professional Liability for Consultants & Contractors

Environmental consultants, remediation, abatement and restoration contractors (asbestos, lead, mold) and even architects and engineers - all face professional liability for acts of errors or omissions at a job site that can lead to pollution conditions.  Additionally they face liability stemming from “pollution conditions” at a covered location and from their completed operations.

Standard coverage typically includes two coverages:

1. Professional liability coverage – for an error or omission that could lead to a pollution condition
Environmental Professional performs a Phase I report and deems the site ‘contamination free.’  The end-user relies on the report as part of its greater transaction (finance, purchase/sale) and later contamination is found due to an error or omission.  Who do you think is going to be sued for the resultant pollution condition?

2. Contractor’s Pollution Liability – for completed operations for covered locations

If an environmental consultant, contractor, subcontractor; architect or engineer performs work at a site – which later is found to have created a pollution condition coverage is needed.
